A. C. vs OFFICER SHERBERT AND OFFICER CLARK – GREENVILLE COUNTY SHERIFF’S OFFICE

A. C. was arrested in April 1988 for disorderly conduct and resisting arrest. During her arrest, she was jerked out of a chair with such force that her arm was broken in several places. Prior to her criminal trial the prosecutor offered her a guarantee of no jail time, but A. C. refused. In the situation A. C. faced, she could easily have accepted the plea deal without a risk of jail. If she had accepted the offer however, she would never have been able to seek recovery for her injuries or set the record straight. She decided to trust the criminal trial jury and told her story in open court. The jury did not let her down and she was cleared. Her not guilty verdict then made it possible to seek damages for her injuries. Her civil case later ended with a confidential settlement.
